Terms of Use

These terms of use (the “Terms”) apply to your use of the websites available at https://bcplebanon.org in English, Arabic and French (the “websites”), published by the Beirut Center of Photography (BCP, “we”, “our”, “us”), a non-profit organisation based in Lebanon.

Please read these Terms and our privacy policy before using the websites. By using the websites, you agree to be bound by these Terms.

We reserve the right to modify or to update these Terms and our privacy policy at any time and at our sole discretion. Please consult these Terms and our Privacy Policy on a regular basis as any modification thereto becomes effective upon publication on the websites.

Some features of the websites (such as the content sharing features or video players) are integrated into the website but operated by third parties. When using these features on or from the websites, you undertake to do so in strict compliance with the terms of use applicable to such features.

Ownership and use of the Websites and Content

The websites, all their components and their content in any form (photos, texts, videos, still and animated graphics, etc.) displayed on or accessible through the websites (the “Content”) are the exclusive property of BCP and/or its partners and are protected by intellectual property laws.

The Content available on the BCP websites is provided for information and non-commercial purposes only. Any reproduction, communication to the public or distribution of the websites and/or the Content, in whole or in part, for any purpose, including sharing on Social Media, without BCP’s written approval, is strictly prohibited.

Donations

The BCP can accept online and offline donations through its websites. Acceptance of any contribution, gift or grant is at the discretion of the Beirut Center of Photography (BCP). The Beirut Center of Photography will not accept any gift unless it can be used or expended consistently with the purpose and mission of the BCP.

No irrevocable gift, whether outright or life-income in character, will be accepted if under any reasonable set of circumstances the gift would jeopardise the donor’s financial security.

The Beirut Center of Photography will refrain from providing advice about the tax or other treatment of gifts and will encourage donors to seek guidance from their own professional advisers to assist them in the process of making their donation.

The Beirut Center of Photography will accept donations of cash or publicly traded securities. Gifts of in-kind services will be accepted at the discretion of the Beirut Center of Photography.

Certain other gifts, real property, personal property, in-kind gifts, non-liquid securities, and contributions whose sources are not transparent or whose use is restricted in some manner, must be reviewed prior to acceptance due to the special obligations raised or liabilities they may pose for Beirut Center of Photography

The Beirut Center of Photography will provide acknowledgments to donors meeting tax requirements for property received by the BCP as a gift. However, except for gifts of cash and publicly traded securities, no value shall be ascribed to any receipt or other form of substantiation of a gift received by Beirut Center of Photography.

The Beirut Center of Photography will respect the intent of the donor relating to gifts for restricted purposes and those relating to the desire to remain anonymous. With respect to anonymous gifts, the Beirut Center of Photography will restrict information about the donor to only those staff members with a need to know.

The Beirut Center of Photography will not compensate, whether through commissions, finders’ fees, or other means, any third party for directing a gift or a donor to the BCP.

Warranties

As a user of the websites, you hereby warrant and represent that you will access and use the websites, its features and the Content in strict compliance with these Terms, the applicable laws and the terms of use applicable to any third party features integrated into the websites but operated by third parties.

You hereby undertake to defend, indemnify and hold harmless BCP and its partners from and against all expenses (including, but not limited to, reasonable legal fees and expenses), costs, losses, liabilities, damages, arising out of or in connection with any claim, demand, action, proceeding, directly or indirectly resulting from or based on a breach by you (or your staff) of this warranty.

Limitations and disclaimers on liability

The access to or the availability of the Content, the websites or any of their features (including third party features) may be totally or partially interrupted or may run slowly due to causes beyond BCP’s control. It may also be totally or partially modified, suspended, interrupted or restricted by BCP at any time.

BCP cannot guarantee that the Content, the websites and their features (including third party features) are provided without interruption, server downtime or delay or free from errors or any breach of security due to hackings, security intrusions, bugs, viruses, malwares, etc. that may affect your hardware, software or data. Your use of the websites, their features and the Content is under your full and sole liability.

In no event shall BCP be liable for any damages whatsoever arising out of or related to the access to or use of, or the impossibility to access or use, the websites, their features (including third party features) or the Content.

BCP is not responsible for the third party’s websites referenced on its websites or referencing its websites. References made to third party’s websites on the BCP websites shall by no means be construed as an endorsement by BCP or its partners of these websites or their content. Third party’s websites and their content are governed by their own terms of use.

Trademarks and logos

The trademarks, logos and distinctive signs appearing on the websites are the sole property of BCP and/or its partners. They may only be used, in whole or in part (including as a link to the websites), with BCP’s and/or BCP’s partners prior written approval and in strict compliance with BCP’s and/or BCP’s partners graphic charter.

Governing law – Jurisdiction

These Terms and any dispute arising thereof shall be governed by and construed in accordance with Lebanese law.

The Courts of Beirut (Lebanon) shall have exclusive jurisdiction notwithstanding any actions in warranty or plurality of defendants.
